A woman has taken legal action against a grocery store chain, claiming negligence after suffering injuries from a slip and fall incident. Gabriela Marquez filed the complaint on December 26, 2024, in the District Court of Harris County, Texas, accusing Lewis Food Town, Inc. of failing to maintain safe premises.
According to the court documents, Marquez alleges that on December 18, 2023, she was shopping at a Food Town store located at 20851 FM 1485 in New Caney, Texas when she slipped on water in the frozen meals aisle. The plaintiff claims that the floor was not slip-resistant and that the store failed to adequately maintain the aisle. As a result of her fall, Marquez suffered serious bodily injuries. The lawsuit accuses Lewis Food Town of negligence and premises liability for allowing dangerous conditions to exist within their store without adequate warning or maintenance.
The complaint details several allegations against Lewis Food Town, including negligently allowing the premises to become dangerous and failing to keep the store floor free of slippery conditions. It further claims that the defendant did not inspect or correct these hazardous conditions or provide sufficient warnings to customers about potential dangers. "Defendants owed a duty to exercise ordinary care to keep the premises in a reasonably safe condition," states Marquez's petition.
Marquez is seeking monetary relief exceeding $250,000 but less than $1 million for damages such as past and future medical expenses, pain and suffering, physical impairment and disfigurement, lost wages, and loss of earning capacity. She has requested a jury trial and seeks pre-judgment interest along with any other relief deemed appropriate by the court.
