A shopper has filed a lawsuit against a major retail corporation, alleging negligence after an incident at one of its stores left her injured. Candace Foley initiated the legal action against Target Corporation in the District Court of Harris County, Texas, on December 23, 2024. The complaint centers around an accident that occurred earlier in the year when Foley visited a Target store undergoing renovations.

According to the petition, Foley was shopping at a Target location in Lake Charles, Louisiana, on January 3, 2024. She claims she was unaware of ongoing construction activities at the store and lost her balance near the entrance. A nearby Target employee attempted to assist by moving a shopping cart towards her; however, this resulted in Foley colliding with the cart and sustaining injuries to her face and head. Despite reporting the incident to store management, no medical assistance was offered on-site, compelling Foley to seek care independently.

Foley's lawsuit accuses Target Corporation of multiple acts of negligence. The allegations include failing to maintain safe premises during renovations and not adequately warning customers about potential hazards. The plaintiff asserts that these failures are violations of premises liability laws intended to protect invitees like herself from harm due to unsafe conditions or negligent activities within commercial properties.

The complaint further criticizes Target for insufficient employee training regarding hazard identification and inadequate signage marking dangerous areas within the store. It highlights specific oversights such as neglecting necessary repairs and disregarding safety protocols that could have prevented similar incidents. Citing these lapses as contributing factors to her injury, Foley argues that they constitute negligence per se under Texas law.

In terms of relief sought, Foley is pursuing monetary compensation ranging from $250,000 to less than $1 million for damages incurred due to her injuries. She seeks recovery for past and future medical expenses, loss of earning capacity, mental anguish, psychological treatment costs, and other economic losses resulting from the accident.

Representing Candace Foley is attorney David Clarke Rushing from Rushing Law Group based in Houston. The case has been assigned Case ID 2024-88728 in Harris County's 157th Judicial District Court.
