Plaintiffs Allege Restaurant Negligence After Severe Food Poisoning Incident

A lawsuit has been filed against a Texas-based corporation following a severe case of food poisoning that left two individuals with debilitating injuries. The plaintiffs, Maria Magdalena Ortiz and Sally Renita Shaw, have initiated legal proceedings against VOS LLC, doing business as URBE, in the District Court of Harris County, Texas. The complaint was officially filed on December 27, 2024.

According to the details outlined in the lawsuit, Ortiz and Shaw allege that they suffered from food poisoning after dining at URBE on May 22, 2023. Ortiz claims she experienced severe symptoms shortly after consuming a meal at the restaurant located at 1101 Uptown Park Boulevard in Houston. Her symptoms included high fever, cramping, vomiting, and diarrhea which led to her being hospitalized with sepsis and diagnosed with bacterial infections such as Campylobacter and Cdiff. Similarly, Shaw reported experiencing dehydration and other related symptoms after eating a chicken sandwich at the same establishment.

The plaintiffs argue that VOS LLC failed to maintain safe premises for its patrons by neglecting to warn them of potential hazards or ensuring the safety of their food products. They assert that these failures constitute negligence under Texas law. The lawsuit accuses VOS LLC of breaching its duty of care by not adequately inspecting or maintaining safe conditions within the restaurant premises.

Ortiz and Shaw are seeking monetary relief exceeding $250,000 for their physical pain, mental anguish, lost wages, medical expenses, and other damages resulting from their ordeal. They also demand punitive damages due to what they describe as gross negligence on part of VOS LLC.

Representing the plaintiffs is attorney Willie D. Powells III from Law Offices of Willie D. Powells III & Associates PLLC. The case has been assigned to Judge Cally Mitchel under Case ID 2024-89083 in the 215th Judicial District Court.
