In a dramatic legal move, an individual has taken action against a local restaurant, alleging negligence that led to serious injuries. On January 10, 2025, Breylin A. Castellano filed a complaint in the District Court of Harris County, Texas, targeting AhiPoke Fairmont, LLC for their alleged role in an incident that occurred on December 1, 2023.

The lawsuit claims that Castellano was visiting the AhiPoke store located at 5716 Fairmont Parkway in Pasadena when she slipped on a slippery substance on the floor. According to the petition, there were no warning signs or cones to alert her of the hazard. The complaint accuses AhiPoke Fairmont of failing to maintain safe premises and allowing dangerous conditions to persist without adequate warnings. The plaintiff asserts that these oversights constitute negligence and premises liability under Texas law.

Castellano's filing details several accusations against AhiPoke Fairmont, including "negligently allowing the premises to become dangerous" and "failing to keep the store floor in a reasonably safe condition." The plaintiff argues that the restaurant had a duty to ensure safety by inspecting for latent defects and making necessary corrections or providing warnings about potential dangers. The absence of such measures allegedly resulted in Castellano suffering significant bodily harm when she fell.

Seeking justice for her injuries, Castellano is pursuing monetary relief exceeding $250,000 but less than $1 million. This amount includes damages for past and future medical expenses, pain and suffering, physical impairment and disfigurement, lost wages, and diminished earning capacity. Additionally, she requests pre-judgment interest as well as post-judgment interest should her case prevail.
