Ronald Moore has filed a lawsuit against Kroger Texas L.P., alleging negligence after suffering severe injuries while working at one of the company's locations. The complaint was filed on January 9, 2025, in the District Court of Harris County, Texas, with Moore seeking over $1 million in damages from Kroger Texas L.P.
The incident that prompted this legal action occurred on June 22, 2022. According to the petition, Moore was instructed by his supervisor to straighten up a stack of pallets inside a Kroger trailer. During this task, a board on one of the pallets broke, causing several pallets to fall and strike Moore on the head and shoulder. This accident resulted in serious bodily injuries to Moore's neck and shoulder, necessitating substantial medical treatment. The plaintiff claims that Kroger's negligence directly led to these injuries. As detailed in the filing, "Defendant’s negligence was the proximate cause of the severe injuries and damages suffered by Mr. Moore."
Moore accuses Kroger of failing to provide a safe work environment and neglecting necessary safety protocols regarding pallet maintenance or discard. He further alleges that Kroger did not implement adequate safety measures or warn employees about potential hazards. Notably, Kroger is identified as a non-subscriber to the Texas Workers’ Compensation system, making them liable for any workplace injuries under state law.
In his plea for relief, Moore requests compensation for past and future medical expenses, physical pain and suffering, mental anguish, disfigurement, lost wages, and loss of earning capacity. He also seeks costs of suit along with prejudgment and post-judgment interest.
