Gladys Fajardo has taken legal action against Anderson Alexis Itzep Alonzo, filing a complaint in the District Court of Harris County on January 9, 2025. The lawsuit arises from an auto-pedestrian incident involving Fajardo's minor child, Jossie Herrera, which occurred on August 15, 2024.
According to the complaint, the incident took place in Harris County when Jossie Herrera was lawfully walking within a designated crosswalk on Telephone Road. Anderson Alexis Itzep Alonzo allegedly exited a private driveway and proceeded south without yielding the right-of-way, resulting in a collision with Herrera. As stated in the court documents, "Defendant failed to yield the right-of-way resulting in a collision with Plaintiff." The plaintiff claims that this negligence led to personal injuries and damages exceeding the court's minimum jurisdictional limits.
The lawsuit accuses Alonzo of operating his vehicle negligently and breaching his duty of care by failing to maintain proper lookout, control speed and distance between vehicles, and yield the right-of-way. The plaintiff argues that these actions constitute negligence per se under Chapter 545 of the Texas Transportation Code. The plaintiff contends that "but for the conduct of the Defendant," the accident would not have occurred.
Fajardo is seeking monetary relief ranging from $250,000 to $1 million for medical expenses (past and future), pain and suffering (past and future), impairment (past and future), lost wages (past and future), as well as pre-judgment and post-judgment interest at the maximum rate allowed by law. She also requests all costs incurred during litigation be recovered from Alonzo.
