Construction Worker Alleges Negligence Against Employers Victor Duran and Jesus Estrada Following Job Site Injury

Saul Holguin has filed a lawsuit against Victor Duran and Jesus Estrada, accusing them of negligence that led to his severe injuries while working on a construction site. The complaint was lodged in the District Court of Harris County, Texas, on January 10, 2025. Holguin is seeking over $1 million in damages from Duran and Estrada.

The case stems from an incident on August 5, 2023, when Holguin was employed by the defendants to work on a construction project at 810 E. Cypresswood in Spring, Texas. According to the petition, Holguin was injured when Maria Estrada, operating an excavator under the supervision of the defendants, mishandled a rafter which struck him violently. This resulted in Holguin falling from a height due to lack of proper safety equipment like harnesses. The plaintiff claims that despite complaints about inadequate safety measures and equipment at the job site, no action was taken by Duran and Estrada.

Holguin's lawsuit accuses the defendants of multiple counts including negligence for failing to provide a safe working environment as required by law. He argues that they breached their duty by not ensuring proper safety protocols or providing necessary equipment for lifting heavy materials safely. Additionally, he claims premises liability as he was an invitee on their property where unsafe conditions were present.

The plaintiff further alleges negligent hiring and supervision by Duran and Estrada for not adequately training or overseeing their employees or contractors responsible for maintaining safe conditions at the site. He also holds them vicariously liable for the actions of their employees during the incident under doctrines such as respondeat superior.

Holguin seeks various forms of relief including actual damages for medical expenses incurred due to his injuries and future medical costs anticipated because of ongoing treatment needs. He also requests compensation for physical pain suffered both past and future along with mental anguish experienced as a result of this traumatic event. Furthermore, due to what he describes as gross negligence by the defendants—showing conscious indifference towards his safety—Holguin demands exemplary damages intended to punish such reckless behavior.
