Employee Sues Restaurant Chain Manny's Pizza LLC Over Negligence After Car-Jacking Incident

Jesus Emilio Mendez Monsalve has filed a lawsuit against Manny's Pizza LLC, alleging negligence after a harrowing car-jacking incident that left him with serious injuries. The complaint was lodged in the District Court of Harris County, Texas, on January 10, 2025. Mendez Monsalve accuses Manny's Pizza LLC of failing to ensure the safety of its employees and seeks over $1 million in damages.

According to the petition, Jesus Emilio Mendez Monsalve, a resident of Harris County and an employee at Manny’s Pizza LLC, was instructed by his manager to deliver an order outside their usual delivery range on January 11, 2023. Upon arrival at the destination, he discovered that the homeowner had not placed any order and had been receiving unsolicited deliveries throughout the day. This confusion led to a terrifying encounter where Mendez Monsalve was car-jacked and dragged from his vehicle, resulting in loss of consciousness and severe injuries.

The plaintiff claims that Manny’s Pizza LLC failed in its duty to provide a safe working environment for its employees. The allegations include not warning employees about potential dangers during deliveries, inadequate training on handling dangerous situations like car-jackings, and lacking proper policies to ensure safe deliveries. These failures are said to have directly contributed to the incident and Mendez Monsalve's subsequent injuries.

Mendez Monsalve is seeking compensation for physical pain, mental anguish, loss of earnings both past and future, medical expenses incurred due to his injuries, as well as exemplary damages for gross negligence. He argues that Manny’s Pizza LLC should be held liable under the doctrine of Respondeat Superior since they are responsible for their employees' safety while performing job-related duties.

Higdon from Higdon Lawyers based in Bellaire, Texas, Jesus Emilio Mendez Monsalve is determined to hold Manny’s Pizza accountable for what he describes as preventable negligence. The case has been assigned Case ID 2025-01953 in the 61st Judicial District Court of Harris County.
