On January 17, 2025, Charlotte Fisher filed a complaint in the District Court of Harris County, Texas, against Pappas Restaurants, Inc. and Pappadeaux. The lawsuit stems from an incident that occurred on November 9, 2024, when Fisher fell and broke her hip at one of the defendant's restaurants.
According to the petition filed by Fisher, she was visiting the Pappadeaux restaurant located at 7110 FM 1960 W., Houston, Texas when the accident took place. As she was returning from the restroom, an unsupervised child playing on the floor unexpectedly moved into her path, causing her to fall. Fisher contends that this incident resulted from negligence on the part of Pappas Restaurants and Pappadeaux in managing their premises and ensuring customer safety. "Defendants failed to prevent persons from bringing and allowing an unsupervised small child to run around loose," states the petition.
Fisher argues that as an invitee on the premises for mutual economic benefit with the defendants, they owed her a duty of care to maintain a safe environment. The lawsuit accuses them of failing to adequately supervise or warn patrons about potential hazards such as unsupervised children running loose in the restaurant. Additionally, it claims that employees were not properly trained to manage such situations effectively.
The plaintiff is seeking monetary damages exceeding $1 million for medical expenses incurred due to her injuries, as well as compensation for physical pain and mental anguish both past and future. Specifically, she demands $300,000 for medical costs already incurred and anticipated future expenses; $550,000 each for past and future physical pain and mental anguish; along with other related damages including court costs and interest.
