Plaintiff alleges negligence against grocery chain following delivery accident

Fernando Gonzalez has filed a lawsuit against Cox's Foodarama Inc., alleging negligence after suffering injuries while delivering a shipment at one of the company's stores. The complaint was filed on January 17, 2025, in the District Court of Harris County, Texas. Gonzalez claims that an employee moved a ramp or similar object that struck him, resulting in severe injuries including a fracture and lacerations to his right ankle.

According to the petition, Gonzalez was an invitee on the premises owned by Cox's Foodarama Inc., which is located at 915 6th Street North, Texas City, Texas. He asserts that the company had a duty to ensure his safety and protect him from dangerous conditions but failed to do so. The plaintiff accuses Cox's Foodarama Inc. of various acts of negligence such as failing to comply with safety regulations, not maintaining safe work practices, and inadequately training employees. "Defendant undertook the duty to ensure a safe Premises but performed their duties in a manner that exposed Plaintiff and other members of the public to needless risk of injury," states the petition.

Gonzalez seeks compensation for physical pain and suffering, mental anguish, loss of earnings, medical expenses, and other damages exceeding $1 million. Additionally, he requests punitive damages due to what he describes as gross negligence by Cox's Foodarama Inc., citing their "heedless disregard" for his rights and safety.
