Sesley Barajas Gonzalez has filed a lawsuit against two prominent Texas-based companies, alleging negligence that led to personal injuries. The complaint was filed on January 17, 2025, in the District Court of Harris County, Texas, targeting H-E-B, LP doing business as Mi Tienda and One Source Cleaning Solutions, Inc.
The case revolves around an incident that occurred on March 13, 2023, at the Mi Tienda market located at 3800 Little York Road in Houston. Gonzalez claims she slipped and fell on grapes while shopping in the produce section of the store. According to the lawsuit, H-E-B owned and operated the store at the time of the incident, while One Source Cleaning Solutions was responsible for maintaining cleanliness and safety on the premises. The plaintiff accuses both defendants of failing to ensure a safe environment by not providing adequate warning signs or barriers around hazardous conditions like loose grapes on the floor.
Gonzalez's legal action cites multiple instances of alleged negligence by both defendants. These include failure to maintain a reasonably safe condition on their property, inadequate cleaning practices, lack of proper inspection protocols, and insufficient warnings about potential hazards. "Defendants knew or reasonably should have known that grape(s) on the floor contained no warning signs and were in harm’s way of Plaintiff," states Gonzalez's petition.
The plaintiff is seeking monetary compensation ranging from $250,000 to $1 million for damages including physical pain and suffering, mental anguish, medical expenses incurred due to her injuries, loss of earnings capacity, disfigurement, and physical impairment. Additionally, Gonzalez requests pre-judgment interest as part of her damages claim under Texas law.
