Greenfield Village Homeowners Association has taken legal action against a property owner for failing to meet financial obligations. The complaint was filed by the Greenfield Village Homeowners Association in the District Court of Harris County on January 17, 2025, naming Fino Enterprises, LLC as the defendant.
The case centers around allegations that Fino Enterprises, LLC breached a contract by not paying maintenance fees and special assessments as required by the community's restrictive covenants. These covenants were established by the original developers of the subdivision and are legally binding on all property owners within Greenfield Village. According to the petition, these restrictions are recorded in Harris County Real Property Records and serve as an operative contract between the homeowners association and property owners like Fino Enterprises.
Greenfield Village Homeowners Association claims that despite owning Lot Forty in Block Three of Greenfield Village, Section Two, Fino Enterprises has failed to fulfill its financial obligations under these covenants. "Defendant is obligated to pay Plaintiff the amounts owed," states the petition, which goes on to detail how Fino Enterprises' failure to pay has necessitated this lawsuit. The association is seeking not only payment of past due amounts but also foreclosure of a vendor’s lien placed on the property as security for these payments.
In addition to recovering unpaid fees, Greenfield Village Homeowners Association is asking for pre-judgment interest, post-judgment interest, court costs, and reasonable attorney fees associated with both pre-trial and post-judgment actions. They also seek an order for foreclosure of the vendor’s lien against Fino Enterprises’ property if necessary. Furthermore, they request an order of sale for the property should it be required to satisfy any remaining debt after applying proceeds from such a sale.
The plaintiff argues that all conditions precedent have been met for recovery under Chapter 209 of Texas Property Code. Additionally, they assert their right to recover attorney fees under Section 38.001 of Texas Civil Practice and Remedies Code and Section 5.006 of Texas Property Code due to Defendant's breach necessitating legal action.
