Angela Simon has filed a lawsuit against three healthcare entities, alleging severe negligence and mistreatment of her father, Willie Washington, while he was under their care. The complaint was lodged on January 17, 2025, in Harris County District Court against McKay Health Care LLC, doing business as Crimson Heights Health and Wellness, Fundamental Healthcare LLC, and THI of Texas LLC.
Angela Simon, acting as the power of attorney for her father Willie Washington, claims that during his stay at Crimson Heights from March to August 2024, he suffered significant neglect leading to physical injuries. The petition states that Washington endured multiple falls and developed pressure ulcers due to inadequate care. It further alleges that despite being aware of Washington's medical conditions such as hypertension and hemiplegia, the defendants failed to provide necessary care plans or adequate supervision. "Defendants represented they were able to adequately care for Willie Washington’s conditions," the petition reads. However, Simon asserts that this was not the case.
The lawsuit details numerous incidents where Willie Washington was left in soiled diapers and experienced weight loss due to neglect. On several occasions, he fell due to unsafe conditions at the facility—once resulting in a brain injury requiring surgery. Angela Simon accuses the defendants of gross negligence for failing to prevent these foreseeable risks despite having prior knowledge of them. The complaint argues that this negligence violated both federal and state regulations meant to protect nursing home residents.
Simon seeks damages for her father's pain and suffering caused by what she describes as systematic understaffing and poor management practices at Crimson Heights. She requests economic and non-economic damages exceeding the court's minimum jurisdictional limits along with interest and legal costs. Furthermore, she demands punitive damages under Texas law for what she claims is an extreme degree of risk posed by the defendants' actions.
