Plaintiff Telecommunications Company Sues Texas Contractor for Negligence Over Cable Damage

MCImetro Access Transmission Services LLC has filed a lawsuit against a Texas corporation, alleging severe damage to its telecommunications infrastructure. The complaint was lodged in the District Court of Harris County on January 16, 2025, targeting Ramon Ortega Ramos Contractor Inc. as the defendant.

The case revolves around an incident that allegedly occurred on January 18, 2023, when MCImetro claims that Ramon Ortega Ramos Contractor Inc. (RORC) engaged in unauthorized excavation activities at a critical intersection in Aldine, Harris County, Texas. According to the petition filed by MCImetro Access Transmission Services LLC, RORC's actions resulted in significant damage to underground fiber-optic cables owned by MCI. The plaintiff contends that these cables are vital for their telecommunications services and are protected under state statute and agreements with local authorities.

MCImetro asserts that the defendant's actions were not only unauthorized but also grossly negligent and reckless. "The actions of Defendant RORC were grossly negligent and/or reckless," the complaint states, accusing RORC of failing to adhere to industry standards during excavation work. Specifically, MCI alleges that RORC did not plan adequately to avoid interference with underground utilities and failed to train or supervise its employees properly. As a result of these alleged failures, MCI claims it suffered damages amounting to at least $66,479.03 due to direct and indirect repair costs.

In addition to seeking compensation for actual damages, MCImetro is pursuing punitive damages against RORC. The company argues that such damages are necessary "to punish Defendant RORC for its actions" and deter similar conduct in the future. The lawsuit further demands interest on the claimed amounts as allowed by law and requests all legal costs associated with the action be covered by the defendant.
