Daisy Johanny Cruz Muniz has filed a lawsuit against a major retail corporation following an incident that allegedly left her with significant injuries. The complaint was filed on January 17, 2025, in the District Court of Harris County, Texas, against Wal-Mart Stores Texas, L.L.C., alleging negligence and premises liability.
According to the details laid out in the court documents, Daisy Johanny Cruz Muniz was shopping at a Wal-Mart store located at 25108 Market Place Drive in Katy, Texas, on June 11, 2023. While entering the store with her baby in her arms, she slipped on an unidentified substance on the floor. This fall resulted in substantial injuries to Muniz. The lawsuit claims that this substance created a hazardous condition within the store premises and that Wal-Mart was either aware or should have been aware of this danger but failed to take appropriate action to clean it up or warn customers about it. The plaintiff argues that her injuries were directly caused by the defendant's negligence.
Muniz's legal filing asserts that she did nothing to contribute to the accident or her resulting injuries. She is seeking damages for personal injuries under several categories including past and future medical expenses, physical pain and suffering, mental anguish, loss of earnings and earning capacity, loss of consortium and household services, disfigurement, and fear of future disease or condition. Furthermore, Muniz is also pursuing exemplary damages due to what she describes as Wal-Mart's gross negligence—claiming they acted with conscious indifference towards her safety despite knowing the risks involved.
The plaintiff’s legal representation from Marcos & Associates P.C., led by attorney Javier Marcos Jr., emphasizes that they are demanding a jury trial for this case. They are seeking monetary relief over $250,000 but not exceeding $1 million. In addition to compensatory damages for medical costs and other losses incurred due to the incident, they are also asking for pre-judgment and post-judgment interest along with court costs.
This case will be heard in front of Judge Wanda Chambers in Harris County’s 11th Judicial District Court under Case ID 2025-03607. As proceedings unfold, both parties will engage in discovery under Level 3 control plan rules as outlined by Texas law.
