Customer Alleges Negligence Against Grocery Chain After Forklift Incident

Rosa Giron has filed a lawsuit against a major grocery chain and its cleaning service provider, seeking justice for severe injuries she sustained due to alleged negligence. The complaint was lodged by Giron in the District Court of Harris County, Texas, on January 16, 2025, targeting H-E-B, LP d/b/a Joe V’s Smart Shop and One Source Cleaning Solutions, Inc., along with an unidentified employee referred to as John Doe.

According to the details outlined in the petition, Rosa Giron was involved in a serious incident on November 16, 2024, at Joe V’s Smart Shop located at 612 North Victory Drive in Houston. While shopping as an invitee customer, Giron claims she was struck by a forklift operated negligently by an employee of either Joe V’s or One Source Cleaning Solutions. The collision resulted in significant personal injuries for which she is now seeking compensation. "Defendant JOHN DOE owed a duty to exercise ordinary care," states the petition, accusing the employee of failing to maintain proper control and awareness while operating the forklift.

The lawsuit asserts multiple causes of action including negligence and negligent undertaking against both corporate defendants. It alleges that they failed in their responsibility to hire competent staff and provide adequate training and supervision for their employees. Furthermore, it accuses them of not adhering to industry safety standards which contributed directly to Giron's injuries. As per the filing, these lapses have caused Giron substantial medical expenses and loss of earning capacity among other damages.

Giron's legal representation is demanding monetary relief exceeding $250,000 but not more than $1 million from the defendants. The plaintiff seeks compensation for past and future medical expenses, lost wages, physical pain and suffering, mental anguish, physical impairment, disfigurement as well as exemplary damages within the jurisdictional limits of the court. Additionally, she requests pre-judgment and post-judgment interest on all accrued damages.
