Patron Sues Restaurant Over Negligence After Slip-and-Fall Incident

Genoveva Garcia Aguirre has filed a lawsuit against Winsanco LLC, doing business as Thai Spice Express, following an incident that left her with significant injuries. The complaint was lodged on January 17, 2025, in the District Court of Harris County, Texas. Aguirre is seeking monetary relief ranging from $250,000 to $1,000,000 due to the alleged negligence of the defendant.

The incident occurred on March 30, 2023, when Aguirre visited Thai Spice Express located at 8282 Bellaire Boulevard in Houston. While walking towards a fountain machine inside the restaurant, she slipped and fell on a wet floor. According to the petition, there were no warning signs posted to alert patrons of the hazardous condition. Aguirre claims that her fall resulted in painful bodily injuries and asserts that she did nothing to contribute to the accident.

Aguirre accuses Winsanco LLC of negligence for failing to maintain safe premises for its patrons. The lawsuit outlines several points where the defendant allegedly breached their duty of care: creating a dangerous condition by allowing a wet floor without warnings or barriers; failing to ensure safe conditions; inadequate employee training and supervision; and neglecting to enforce safety guidelines. "Defendants knew or reasonably should have known of the danger posed by the wet floor," states Aguirre's petition.

In addition to physical pain and mental anguish resulting from her injuries, Aguirre claims she has incurred medical expenses and lost wages due to the incident. She anticipates needing further medical treatment in the future and seeks compensation for these ongoing costs. Furthermore, Aguirre demands pre-judgment interest as part of her damages claim.

Represented by attorney Joel Joseph from Miller Weisbrod Olesky LLP based in Houston, Aguirre requests that Winsanco LLC be held accountable for their alleged negligence through both actual damages and additional relief deemed appropriate by the court. The case is presided over by Judge Marilyn Burgess under Case ID 2025-03758.
