Kindra Davis, a former district manager, has filed a lawsuit against her previous employer, alleging racial discrimination and retaliation. The complaint was lodged by Davis on January 23, 2025, in the District Court of Harris County, Texas, targeting Dollar Tree Stores, Inc. as the defendant.
The case centers around Davis's claim that she faced discriminatory treatment based on her race and national origin during her tenure at Dollar Tree. Employed since March 2014 and promoted to district manager by March 2015, Davis managed multiple retail outlets in Houston's southwest sales region. Her career took a turn in May 2023 when she was reassigned from a predominantly Caucasian district to a high-crime area known as the "Northside," which had an overwhelmingly African American demographic. She alleges this transfer was racially motivated and aimed at advancing a less qualified Caucasian colleague.
Davis's petition outlines instances of disparate treatment compared to her white counterparts. For example, she received undue criticism for staffing shortfalls despite similar or worse numbers in other districts managed by white colleagues who were not reprimanded. In April 2024, after evaluating an underperforming store managed by an African American subordinate with a low score due to its poor condition and theft issues, Davis was pressured by Regional Director Kenneth Galewek to alter her assessment. Galewek allegedly threatened her job security if she did not comply with his directive to "smooth things over" with the store manager.
The plaintiff asserts that these actions constitute violations of the Texas Labor Code sections §21.051 and §21.055, which protect against employment discrimination based on race and national origin and prohibit retaliation against employees who oppose discriminatory practices. Davis seeks damages for lost wages and benefits, emotional distress, reputational harm, attorney fees, reinstatement to her previous position, and exemplary damages due to what she describes as malicious conduct by Dollar Tree.
