Cherrie Cosby has taken legal action against a major grocery chain following a slip-and-fall incident that she claims resulted in serious injuries. The lawsuit was filed by Cosby on January 23, 2025, in the District Court of Harris County against Kroger Texas, LP. The plaintiff is seeking compensation for damages allegedly caused by the negligence of the store's employees.

The case revolves around an incident that occurred on December 2, 2023, at a Kroger store located at 12620 Woodforest Blvd., Houston, Texas. According to the complaint, Cherrie Cosby was shopping in the bakery department when she slipped on a slippery substance near a refrigerated display case. She alleges that the employees of Kroger Texas failed to clean up the hazard or provide adequate warning signs to alert customers of the danger. As a result of this oversight, Cosby sustained significant injuries.

Cosby's legal team argues that Kroger Texas was negligent and grossly negligent in maintaining safe premises for its customers. The lawsuit states that "the Defendant knew or in the exercise of ordinary care should have known" about the unsafe condition but failed to address it appropriately. This alleged negligence is claimed to be the proximate cause of Cosby's injuries and subsequent suffering.

In her petition, Cosby outlines several types of damages she seeks compensation for: physical pain and mental anguish experienced both in the past and anticipated in the future; costs associated with medical care and treatment; physical impairment; and lost wages along with loss of earning capacity. These damages are claimed to have been directly caused by Kroger's failure to ensure a safe environment for its patrons.

The plaintiff is demanding a jury trial as per Rule 216 of the Texas Rules of Civil Procedure, emphasizing her constitutional right to have her case decided by her peers. In addition to seeking monetary relief under $75,000 as specified under Discovery Control Level 2 of Rule 190 of the Texas Rules of Civil Procedure, Cosby also requests pre-judgment and post-judgment interest at the highest rate allowed by law, along with court costs and any other relief deemed justifiable by the court.
