In a dramatic turn of events, a Texas resident has filed a lawsuit following an unfortunate auto-pedestrian accident that left him injured. The complaint was lodged by Elisey Mironyuk on January 24, 2025, in the District Court of Harris County against Leslie Stianche and Enterprise Holdings, Inc. The plaintiff is seeking justice for injuries sustained when he was allegedly run over by a vehicle driven by Stianche.
The case stems from an incident that occurred on August 1, 2024, in Harris County, Texas. According to the court documents, Mironyuk was walking through a private parking lot near Jones Road when Stianche, operating a vehicle owned by Enterprise Holdings, Inc., negligently reversed her car without maintaining proper lookout and ran over Mironyuk's foot. The plaintiff claims that this act of negligence resulted in significant personal injuries and damages exceeding the minimum jurisdictional limits of the court.
Mironyuk accuses Leslie Stianche of failing to exercise ordinary care while operating the motor vehicle. The lawsuit details several specific acts of negligence: failing to maintain a proper lookout, not controlling the distance between vehicles, lack of attention while driving, not controlling speed appropriately, and failing to maneuver the vehicle safely to avoid the accident. These actions are cited as direct violations of duties owed to pedestrians and other road users.
Furthermore, Enterprise Holdings is implicated under the theory of negligent entrustment.
