David Esparza has filed a compelling lawsuit against two major corporations, alleging negligence that led to a severe workplace injury. The complaint was lodged by Esparza on January 23, 2025, in the District Court of Harris County, Texas, targeting Occidental Petroleum Corporation and Sharp Roustabout & Construction, LLC.
The case centers around an incident that occurred on January 10, 2025, at an oil and gas drilling location in West Texas. According to the petition, David Esparza suffered traumatic injuries when a heavy piece of equipment fell onto his hand and arm. The complaint outlines various allegations against the defendants, including negligent activity and failure to maintain a safe work environment. "Defendants’ negligence created and/or exacerbated a dangerous situation," states the petition. It further accuses the companies of gross negligence for not ensuring adequate safety measures were in place despite being aware of potential risks.
Esparza's legal team argues that both Occidental Petroleum Corporation and Sharp Roustabout & Construction failed in their duty to provide a safe working environment. They cite multiple failures such as improper equipment affixation, inadequate training for workers, and insufficient safety policies. The lawsuit claims these breaches directly resulted in Esparza's injuries. Additionally, it accuses the defendants of intentional torts by knowingly placing workers in hazardous conditions without proper safeguards.
In terms of relief sought from the court, Esparza is demanding compensatory damages exceeding $1 million for medical expenses, lost income, pain and suffering, mental anguish, disfigurement, loss of enjoyment of life, and other related damages. He also seeks exemplary damages due to what he describes as reckless disregard for worker safety by the defendants.
