Patron sues local bar owner over alleged negligence leading to injury

Sasha Denise Duncan has filed a lawsuit against Masone's, LLC, claiming negligence after suffering injuries at the defendant's bar and restaurant. The complaint was lodged in the District Court of Harris County, Texas, on January 23, 2025. Duncan alleges that Masone's failed to maintain safe premises, leading to her accident.

According to the petition, the incident occurred on July 9, 2023, when Duncan visited Masone’s establishment located at 26281 Northwest Freeway in Cypress, Texas. As she entered the bar area, she slipped on spilled beer or liquid on the floor. The lawsuit claims that the floor was not slip-resistant and that Masone’s did not adequately maintain it. This negligence resulted in Duncan sustaining serious bodily injuries. "Defendant is liable to Plaintiff under the theory of premises liability and negligence," states the petition.

Duncan accuses Masone’s of several acts of negligence including allowing dangerous conditions to exist by failing to keep floors free from slippery substances and not providing adequate warnings about potential hazards. She asserts that as an invitee at the time of her injury, Masone’s owed her a duty of care to ensure their premises were safe for customers. The plaintiff believes that these negligent actions were a direct cause of her injuries.

The plaintiff seeks monetary relief exceeding $250,000 but less than $1 million for damages including physical pain and mental anguish both past and future, loss of earning capacity and wages, disfigurement, physical impairment, medical expenses incurred and anticipated future costs. Duncan demands a jury trial for this case.
