In a gripping legal battle, a Texas resident has taken on one of the largest retail giants in the country, accusing them of negligence leading to severe personal injuries. Ashley Wilson filed a complaint against Wal-Mart Stores Texas, LLC in the District Court of Harris County, Texas on February 13, 2025. The lawsuit arises from an incident that occurred at a Wal-Mart store located at 5200 Fairmont Parkway in Pasadena, Texas.
According to the petition filed by Wilson's attorneys, Richard A. Hinojosa and Noe A. Gonzalez of Hinojosa Law, PLLC, the plaintiff was shopping at the store on August 12, 2024, when she slipped and fell due to spilled liquid on the floor. Wilson claims that this hazardous condition was known or should have been known by Wal-Mart employees and management but was left unaddressed without any warning signs for customers. "The impact was so forceful and sudden that she did not have time to brace for impact," states the petition, highlighting the severity of her injuries.
Wilson alleges that Wal-Mart breached its duty of care by failing to maintain safe premises for its patrons. The complaint outlines multiple failures on part of Wal-Mart including not monitoring floor conditions adequately, not training employees properly, and neglecting to clean up spills promptly or mark hazardous areas as dangerous. These actions are claimed to be negligent and grossly negligent under Texas law.
The plaintiff is seeking monetary relief exceeding $1 million for damages including physical pain and suffering, emotional distress, loss of earning capacity, medical expenses both past and future among others. Additionally, Wilson is pursuing punitive damages claiming that Wal-Mart's conduct demonstrated malice and gross negligence with an "extreme degree of risk" which they were aware of yet acted with conscious indifference towards customer safety.
The case brings into focus issues around corporate responsibility and customer safety within large retail environments where foot traffic is high and hazards can often go unnoticed if proper protocols are not followed diligently. This lawsuit seeks accountability from Wal-Mart Stores Texas LLC while also potentially serving as a cautionary tale for other businesses regarding premises liability.
The case is being handled by Judge Talasha Bradford under Case ID 2025-10221 in Harris County’s 334th Judicial District Court.
