A Harris County resident has taken legal action against a major retail corporation, alleging negligence that resulted in personal injury. On February 20, 2025, Karl Eugene Brown filed a complaint in the District Court of Harris County against Walmart Inc. and Wal-Mart Stores Texas, LLC.
The lawsuit stems from an incident on May 7, 2023, when Brown was shopping at a Walmart location on East Sam Houston Parkway in Houston, Texas. According to the complaint, Brown slipped on a clear liquid substance near the store's open refrigerators. The plaintiff claims that Walmart had actual or constructive knowledge of this hazardous condition but failed to warn customers or rectify the situation. As stated in the filing, "Defendant failed to use ordinary care to protect invitees from danger by failing to adequately warn Plaintiff of or make safe the dangerous condition."
Brown's legal team argues that Walmart breached its duty of care by not maintaining safe premises for its patrons. They assert that Walmart did not have adequate policies or procedures in place to ensure safety and failed to train employees properly. This alleged negligence forms the basis of Brown's claim for premises liability against the defendants.
In terms of relief sought, Brown is asking for monetary compensation exceeding $250,000 but not more than $1 million. The damages cover past and future medical expenses, physical pain and suffering, mental anguish, and loss of earnings and earning capacity. The plaintiff also seeks pre-judgment interest from the date of injury through judgment date and post-judgment interest at the legal rate.
