Plaintiff alleges negligence against construction firms after workplace injury

Wilson Galeas Hernandez has taken legal action against two companies, alleging negligence that led to a serious workplace injury. The complaint was filed by Hernandez on February 20, 2025, in the District Court of Harris County, Texas, targeting Topsoe, Inc., doing business as Haldor Topsoe, Inc., and Tower Force, LLC.

The case stems from an incident on March 13, 2023, at a worksite managed by Topsoe, Inc. in Pasadena, Texas. On this day, a crane operated by Tower Force struck Hernandez with a large piece of sheet metal during windy conditions. This accident resulted in significant injuries to Hernandez. The plaintiff accuses both companies of creating unsafe working conditions and failing to address known hazards. "The Defendants knew or should have known of this unsafe working condition but failed to remedy or correct it," states the complaint.

Hernandez's petition outlines several allegations against the defendants. It claims negligence and gross negligence for not providing a safe working environment and inadequate employee training concerning workplace safety. The lawsuit argues that these failures directly caused Hernandez's injuries. As a result of the incident, Hernandez is seeking damages for physical pain and mental anguish experienced both in the past and anticipated in the future. Additionally, he seeks compensation for lost wages and diminished earning capacity due to his injuries.

The plaintiff requests monetary relief exceeding $250,000 but not more than $1 million. He also seeks exemplary damages to punish the defendants for their alleged misconduct and deter similar behavior in the future. Furthermore, Hernandez demands pre-judgment interest at the maximum legal rate and post-judgment interest as allowed by law.
