Kubota Credit Corporation claims that Nelson Lee Phillips has defaulted on four separate retail installment contracts related to commercial and agricultural equipment. These contracts were executed between December 2022 and April 2023 and involved substantial sums of money totaling over $116,000. According to the plaintiff, each contract was secured by specific pieces of equipment – referred to as Collateral A, B, C, and D – which are believed to be located at Phillips' residence in Crosby, Texas. The corporation asserts that it holds perfected security interests in these items and accuses Phillips of failing to make due payments or return the collateral despite repeated demands.
The legal action stems from several allegations made by Kubota Credit Corporation regarding Phillips' non-compliance with contractual obligations. The company argues that as a result of these breaches, it is entitled to reclaim possession of the collateral items due to its security interest. "As a direct result of Defendant's default," the petition states, "the prospect of payment, performance, or realization of Plaintiff’s interest in the Collateral A, B, C, and D is significantly impaired." The plaintiff also seeks compensation for any deficiency remaining after repossession and sale of the collateral.
In addition to reclaiming possession of the equipment listed as collateral under the agreements – including a KUBOTA ENGLINE GL 14000-USA generator and various LAND PRIDE attachments – Kubota Credit Corporation is pursuing monetary relief not exceeding $250,000. They also seek reimbursement for attorney fees amounting to no less than $1,500 due to costs incurred from filing this suit.
