Elmo Morales, a Texas resident, has filed a lawsuit against Orion Concrete Construction, LLC, alleging wrongful termination and retaliation related to a workers' compensation claim. The complaint was filed on February 21, 2025, in the District Court of Harris County, Texas. Morales accuses his former employer of retaliating against him after he reported an on-the-job injury and sought medical attention.

According to the details outlined in the court documents, Morales was employed by Orion Concrete Construction when he suffered an injury at work on May 14, 2024. He promptly informed his employer about the incident and pursued medical treatment. However, just ten days later, on May 24, 2024, Morales was terminated from his position. The plaintiff contends that this dismissal was not due to any legitimate reason but rather as a pretext motivated by retaliatory intent because he had initiated a workers' compensation claim.

Morales's lawsuit is grounded in allegations that Orion Concrete Construction violated Section 451.001 of the Texas Labor Code by discriminating against him for reporting his injury and pursuing compensation claims in good faith. The complaint further asserts that Morales has suffered significant economic losses and severe mental anguish as a result of his termination and will continue to endure such hardships in the future.

The plaintiff seeks various forms of relief from the court. These include reasonable damages for lost earnings and employee benefits both past and future; compensatory damages for emotional pain and suffering; exemplary damages due to alleged fraud or malice by the defendant; pre-judgment and post-judgment interest; costs of suit; and other relief deemed appropriate by the court including injunctive relief or reinstatement.

Representing Elmo Morales are attorneys Javier Espinoza and Steven Sachs from Espinoza & Brock PLLC. The case is being presided over in Harris County's judicial district with Case ID: 2025-11981.
