Rhonda Sue Marquez has taken legal action against a major retail corporation, accusing it of negligence that led to her injury. While using the restroom facilities there, she encountered an unexpected hazard when water began spraying from a toilet fixture. In her attempt to avoid contact with the water and exit quickly from the stall, Marquez reportedly struck her face and knee. The plaintiff asserts that this incident was due to Costco's failure to uphold its duty of care as a premises owner. "Costco either knew or should have known of the dangerous condition through regular inspections and maintenance," reads the petition. The lawsuit accuses Costco of not remedying the situation or providing adequate warnings about the hazardous condition.

Marquez is pursuing legal action on two counts: premises liability and negligent activity. She argues that as an invitee—someone who entered Costco’s premises for mutual benefit—the company owed her ordinary care to ensure safety by inspecting and warning or curing potential dangers. The failure to place wet caution signs and maintain safe conditions constitutes a breach of this duty, according to Marquez's filing. Additionally, she alleges ongoing negligent activity on behalf of Costco employees contributed directly to her injuries.

The plaintiff seeks monetary relief exceeding $250,000 but not more than $1 million for damages including past and future physical pain, medical expenses incurred due to necessary treatments related to injuries sustained during the incident, and potential future medical costs. Furthermore, Marquez requests compensation for physical impairment experienced both presently and anticipated in future years. Her attorney emphasizes these damages are not just financial but also encompass losses related to health quality and freedom from worry.
