Plaintiff Alleges Negligence Against Macy's Retail Store Following Slip-and-Fall Incident

In a gripping legal battle, a Texas woman has taken on a retail giant following an unfortunate incident that left her with serious injuries. Nubia Yasmina Funes filed a complaint against Macy’s Retail Holdings, LLC in the District Court of Harris County, Texas, on March 7, 2025. The case centers around allegations of negligence and premises liability after Funes suffered injuries from a slip and fall at one of Macy's stores.

According to the petition, Funes was visiting the Macy's store located at 6301 Northwest Loop 410 in San Antonio, Bexar County, Texas, on December 7, 2023. During her visit as a business invitee, she slipped on an unknown substance near the entrance area and fell to the floor. The lawsuit claims that this incident resulted in significant bodily harm to Funes. As stated in the filing, "Plaintiff suffered bodily injuries as a result of the slip and fall." The complaint argues that Macy’s Retail Holdings failed to maintain safe premises for its customers by allowing dangerous conditions to exist without adequate warning or remediation.

Funes accuses Macy’s of several acts of negligence including failing to keep the store floor free from slippery substances and not providing adequate warnings about potential hazards. The lawsuit states that "Defendant is liable to Plaintiff under the theory of premises liability and negligence," emphasizing that Macy's had a duty to ensure safety for all patrons within their property. This duty includes inspecting for latent defects and making any necessary repairs or warnings regarding hazardous conditions.

The plaintiff seeks monetary relief exceeding $1 million for damages including past and future medical expenses, pain and suffering, mental anguish, physical impairment, disfigurement, lost wages, and loss of earning capacity. Additionally, Funes demands pre-judgment interest and requests a trial by jury to resolve these claims.
