Tibucio Coronado has filed a lawsuit against a major insurance company, alleging breach of contract and unfair settlement practices. The complaint was lodged in the District Court of Harris County, Texas, on March 7, 2025, targeting Allstate Vehicle and Property Insurance Company. Coronado claims that the insurance provider failed to honor its obligations under his property insurance policy following significant damage to his home.

According to the court documents, Tiburcio Coronado is a resident of Harris County who holds an insurance policy with Allstate Vehicle and Property Insurance Company. The issue arose when Coronado's property at 12733 Carlsbad St., Houston, suffered extensive damage on July 8, 2024. He promptly filed a claim for compensation under his policy but alleges that Allstate either denied or inadequately compensated him for the damages incurred. "The adjuster assigned to this claim conducted a substandard investigation," states the petition, highlighting what Coronado believes was an incomplete assessment of the damages by Allstate's representative.

Coronado accuses Allstate of violating several provisions of the Texas Insurance Code. Specifically, he cites breaches related to prompt payment statutes and unfair claim settlement practices. He argues that Allstate misrepresented material facts regarding coverage and failed to provide reasonable explanations for their denial or reduction of his claim. Furthermore, he contends that their actions forced him into litigation as they offered substantially less than what was due under his policy terms.

The plaintiff seeks monetary relief amounting to $250,000 or less, excluding interest and other potential penalties. Additionally, Coronado has filed a binding stipulation indicating that damages sought will not exceed $75,000 to prevent removal from state court based on diversity jurisdiction. He requests compensation for actual damages including lost benefits from the policy and legal costs incurred due to this dispute. In cases where knowing violations are proven, he seeks exemplary and treble damages as permitted by law.
