Plaintiff Alleges Negligence Against Former Employer W-Industries

Lucio Antonio Gonzalez has filed a lawsuit against W-Industries and its employee, Luis Grimaldo, alleging negligence that resulted in severe injury. The complaint was lodged by Gonzalez on March 12, 2025, in the District Court of Harris County, Texas, targeting both W-Industries and Grimaldo for their roles in an incident that left Gonzalez with a disfigured hand.

The lawsuit details an incident that occurred on January 24, 2024, at the W-Industries Corporate Headquarters in Spring, Texas. On this day, Gonzalez was employed through JBC Manpower to perform welding work contracted by W-Industries. During his task, an unfortunate mishap involving a forklift operated by Grimaldo led to a serious injury. According to the petition, Grimaldo improperly managed the forklift while moving metal pieces meant for welding. This mismanagement caused the metal to become jammed and subsequently fall onto Gonzalez's right hand when Grimaldo repositioned the forklift forks without warning. As a result of this incident, Gonzalez suffered from a smashed hand and severed fingertip.

Gonzalez's complaint accuses both defendants of negligence. It argues that Grimaldo failed to exercise reasonable care during his operation of the forklift and that W-Industries did not maintain a safe working environment or adequately train its employees. The petition outlines specific failures such as lack of proper supervision and safety equipment which contributed to the hazardous situation leading to Gonzalez’s injuries.

The legal action seeks various forms of relief from the court. Gonzalez is pursuing compensation for physical injuries, mental anguish, medical expenses, lost wages and earning capacity, as well as damages for disfigurement and loss of consortium. Additionally, due to what is described as gross negligence on part of both defendants—highlighting their conscious disregard for safety—Gonzalez is also seeking exemplary damages.

The case has been assigned Case No. 2025-16746 under Judge Gerardo Perez in Harris County's 334th Judicial District Court.
