Progressive County Mutual Insurance Company has filed a lawsuit seeking damages from an individual they claim was responsible for a car accident. The complaint, lodged in the Harris County District Court on May 1, 2025, accuses Brian Evans of negligence leading to a vehicular collision.

The case stems from an incident on May 12, 2024, near US Highway 290 and Senate Avenue in Jersey Village, Texas. According to the complaint, a vehicle driven by Brian Evans collided with a car owned by Progressive's insured party, Elena Bernal. The insurance company asserts that Evans' negligent driving caused damages amounting to $18,477.70. As per the petition, Progressive compensated their insured for these losses and now seeks to recover this amount from Evans through subrogation.

In their filing, Progressive requests that the court allow for installment payment agreements as part of any judgment rendered against Evans. They are pursuing monetary relief under $250,000 and have chosen Level I discovery under Texas civil procedure rules. "Plaintiff prays that Defendant be cited to answer and appear," reads the petition, which further seeks pre-judgment and post-judgment interest along with costs of suit.

Representing Progressive County Mutual Insurance Company is Rathbone Group LLC with attorneys Jessica R. Lobes, Jared B. Hall, and Jehaan “Gigi” Matia listed as counsel. The case is identified under Cause No. 2025-30774 in the 333rd District Court of Harris County.
