Employee sues Market Basket after trip over co-worker's wheelchair

A Hardin County woman has filed suit against Market Basket, alleging she was seriously injured when she tripped over a fellow employee's wheelchair.

Deborah Falkner Norton claims she was working in the pharmacy in the Market Basket located at 655 Lavaca in Beaumont when the incident occurred, according to the complaint filed Dec. 19 in Jefferson County District Court.

Norton was "walking behind the pharmacist" and "tripped on the back wheel of her wheel chair causing Plaintiff to trip and fall," the suit states.

Because of her fall, Norton claims she incurred medical expenses and a loss of earning capacity and suffered pain, discomfort and impairment.

Market Basket had a duty to provide Norton with a safe place to work, but "the work space provided did not allow for safe, unobstructed movement in the work area," the suit states.

Norton is seeking a judgment for unspecified damages, pre-judgment interest, costs and other relief to which she is entitles.

She is represented by W. Don Bush of Bush Lewis in Beaumont.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
