Woman alleges rug at Baytown store concealed object that caused her to trip

HOUSTON – A woman alleges she was injured at a department store in Baytown when she tripped over an object concealed by a rug.

Irma De Leon filed a complaint on Dec. 5 in the Harris County District Court against J.C. Penney Corp. alleging negligence.

According to the complaint, on April 22, 2017, the plaintiff was walking through the entryway at defendant's store at 2000 San Jacinto Mall in Baytown when she tripped over a raised fixture that was concealed by a rug. She alleges she sustained severe injuries resulting in medical expenses, pain and suffering, disability and lost wages. 

The plaintiff holds J.C. Penney Corp. responsible because the defendant allegedly failed to correct the dangerous condition and failed to provide adequate warning about the danger existing upon its premises.

The plaintiff seeks judgment in her favor for all damages she sustained, with interest, costs and such other and further relief to which she may be justly entitled. She is represented by Reed W. Burritt and Alvin Adjei of Burritt Adjei PLLC in Houston.
