Former construction driver alleges company failed to pay overtime, miscalculated pay

SAN ANTONIO — A former driver for Cuatro T Construction alleges he and others were not paid for overtime and that the company's pay by load percentage calculations were fraudulent.

Gilbert Diaz, on behalf of himself and all others similarly situated filed a complaint Feb. 26 in the U.S. District Court for the Western District of Texas Waco Division against Cuatro T Construction Inc., alleging violation of the Fair Labor Standards Act. 

Diaz worked for Cuatro T Construction as a driver from October of 2018 through January 2020. He alleges the company paid drivers "as a percentage of load" despite how many hours they worked each week and failed to pay for overtime. He also claims the amount per load was deflated by Coatro T without showing any proof of how they valued each driver's load. 

Diaz seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Lawrence Morales, II and Allison Hartry of The Morales Firm PC in San Antonio.
