Houston contractor alleges seafood restaurant owes nearly $40,000 for flooring project

GALVESTON — A Houston-based concrete sawing and drilling contractor is alleging a Galveston seafood restaurant failed to pay for materials, labor and equipment it supplied for a flooring project. 

Ashton Sawing & Drilling filed a complaint Oct. 20 in the Galveston County District Court against Pier 6 Seafood LLC and HTRE LLC alleging breach of contract. 

According to the complaint, Ashton, Sawing & Drilling entered into an agreement with Pier 6 and/or HTRE to supply labor and materials for a flooring project at 113 6th Street in San Leon. They allege that Pier 6 and/or HTRE have failed to pay $38,942 for the labor and materials. 

Ashton, Sawing & Drilling also claims that despite its demands to the defendants, Pier 6 and/or HTRE have failed and refused to pay for the labor, materials and equipment they were supplied for the project. 

The plaintiffs state they filed a mechanic's and materialman's lien against the project in the amount of $38,943. Ashton, Sawing & Drilling claim the defendants "knew or reasonably should have known" that the payment was expected for the materials, labor and equipment it provided. 

The plaintiffs seek monetary relief of $100,000 or less and all other just relief. They are represented by William Westcott and Lauren Scroggs of Andrews Myers PC in Houston.
