Houston resident sues local driver for negligence after bicycle collision

A Houston resident has filed a lawsuit following a serious collision involving a bicycle and a truck. Nolan Joseph Breaux, Jr. lodged the complaint against Ana Julia Merino Martinez in the District Court of Harris County, Texas on May 30, 2024.

According to the court documents, the incident occurred on June 28, 2023, in the parking lot of Del Lago Apartments located at 9800 Hollock Street, Houston. Breaux alleges that he was struck by Martinez's white 1999 Ford Work XL F250 truck while walking his bicycle down a designated handicap ramp. The impact left him pinned under the vehicle for several minutes until Martinez’s son-in-law moved the truck to free him.

Breaux contends that Martinez was driving recklessly and at an excessive speed within the parking lot when she hit him. The plaintiff accuses Martinez of multiple counts of negligence including failing to keep a proper lookout, not operating her vehicle attentively or safely, and driving on the wrong side of the parking lot thoroughfare. "Defendant’s acts and/or omissions were the proximate cause of the collision and Plaintiff's resulting injuries and damages," states Breaux in his petition.

The plaintiff is seeking monetary relief amounting to $250,000 or less for medical expenses incurred both past and future, physical pain and suffering, mental anguish, physical impairment, court costs, pre-judgment and post-judgment interest. He also reserves the right to amend this petition based on accruing evidence and damages.

Represented by attorney Ryan D. Havins from The Havins Law Firm L.P., Breaux demands a jury trial for this case which is registered under Case ID: 2024-34225 with Judge Marilyn Burgess presiding over it.
