Texas resident sues flooring company over alleged negligence leading to severe injuries

A recent court filing reveals a gripping case of alleged negligence that resulted in severe injuries to a Texas resident. Jaime Salinas filed the complaint against Floor and Decor Outlets of America, Inc., doing business as Floor Liquidators, Inc., and Nikita Weekes in the District Court of Harris County, Texas, on May 28, 2024.

The incident in question occurred on August 18, 2022, at a Floor and Decor store located at 11542 Gulf Freeway in Houston. According to the plaintiff's original petition, Salinas was seriously injured while retrieving boxes of tile from a pallet when several boxes fell onto his right hand. The resulting injuries included fractures to his right pinky finger, necessitating medical treatment. The lawsuit claims that the tiles were negligently stacked and placed by the defendants. Notably, after the incident occurred, defendant Nikita Weekes allegedly remarked that "this happens all the time," suggesting prior knowledge of similar dangerous conditions.

Salinas contends that both Floor and Decor Outlets of America and Weekes failed in their duty to maintain a safe environment for customers. The plaintiff argues that the defendants were negligent in multiple ways: creating an unreasonably dangerous condition on the premises, failing to warn about this condition, not properly maintaining or inspecting the premises, and not adequately training or supervising employees. Specifically citing Rule 28 of the Texas Rules of Civil Procedure for cases involving trade names or assumed names, Salinas demands that defendants answer under their correct legal names.

The plaintiff seeks monetary relief exceeding $250,000 but not more than $1 million for damages including past and future pain and suffering, mental anguish, medical expenses, loss of earning capacity, impairment and disfigurement, and loss of enjoyment of life. Additionally, Salinas requests pre-judgment and post-judgment interest at the highest rate permitted by law.
