Local Restaurant Sued Over Alleged Negligence Resulting in Severe Injuries

A shocking incident at a local restaurant has led to a lawsuit that could have significant implications for food safety standards. On June 12, 2024, Isaac Segovia and Elsa Segovia filed a complaint in the Harris County District Court against Heights Asian Cafe Inc., alleging severe negligence after they discovered broken glass in their takeout food.

According to the plaintiffs' original petition, Isaac and Elsa Segovia are residents of Fort Bend County, Texas. They allege that on or about June 12, 2023, they ordered food from Heights Asian Cafe located at 2201 Yale St., Houston, TX. After picking up their order and returning home, they served the food to their family. The plaintiffs claim that when they attempted to eat the food, they encountered broken glass inside it, causing injuries to their mouths and teeth. The petition states that "Plaintiffs attempt to consume the food caused Plaintiffs to suffer severe injuries, emotional distress, and mental suffering."

The plaintiffs argue that their injuries were not due to any fault of their own but rather the negligence and gross negligence of Heights Asian Cafe Inc. They accuse the defendant of failing to properly prepare the food by allowing dangerously sharp glass inside it. Furthermore, they allege that the restaurant failed in several other areas including proper supervision and training of its employees as well as implementing adequate safety policies and procedures.

Isaac and Elsa Segovia are seeking monetary relief amounting to $250,000 for various damages including physical pain and suffering in both past and future; mental anguish; physical impairment; disfigurement; medical expenses; punitive damages; pre-judgment interest; post-judgment interest; costs of court; and attorney’s fees. They assert that these damages fall within the jurisdictional limits of the court.

Represented by attorney Lester B. Nichols III from The Nichols Law Group PLLC, the plaintiffs have demanded a jury trial for this case. The petition also includes a request for disclosure under Texas Rule of Civil Procedure 194 and demands that all evidence related to the incident be preserved by Heights Asian Cafe Inc.

The case is being overseen by Judge Christopher Matthews in Harris County District Court under Case ID: 2024-37089.
