Auto Mechanic Sues Employer Over Severe Workplace Injury

A workplace accident has sparked a significant legal battle in Harris County, Texas. On June 10, 2024, Marlon Diaz filed a complaint against Complete Auto Center d/b/a Hua Xin Company and Yun Xu individually in the District Court of Harris County. The lawsuit alleges severe negligence on the part of the defendants, leading to Diaz's debilitating injuries.

According to the court documents, the incident occurred on July 19, 2023, at Complete Auto Center's job site located at 4605 Cook Road, Houston. Diaz was instructed by his employer to inspect and replace a flex pipe catalytic converter on a vehicle with an exhaust system problem. While following these instructions and removing parts of the suspension system, a sharp metal plate fell and severely cut his left hand. The injury has led to ongoing physical pain as well as mental and emotional distress for Diaz.

The plaintiff accuses Complete Auto Center and Yun Xu of multiple counts of negligence and gross negligence. Specific allegations include failure to provide a safe working environment, lack of proper safety equipment, inadequate training for employees, negligent hiring practices, and violation of OSHA regulations. The complaint also highlights that the defendants did not adequately warn Diaz about potential hazards or ensure that safety protocols were followed.

Diaz is seeking substantial monetary relief for his injuries. The damages sought exceed $1 million but are capped at $10 million. The compensation covers various aspects such as past and future medical expenses, lost earning capacity, mental anguish, pain and suffering, disfigurement, loss of consortium, court costs, attorney fees, and exemplary damages.
