Worker Sues Construction Companies Over Severe On-Site Injuries

A worker is suing two companies for severe injuries sustained on the job. Adrian Trevino filed a complaint in Harris County, Texas, on July 12, 2024, against Baker Triangle Prefab, Ltd., Gilbane Building Company, and an unidentified individual referred to as John Doe.

According to the complaint, Trevino was working at a construction site located at 2200 Texas Ave., Houston, Texas, on February 24, 2023. While performing his duties under the control of Baker Triangle Prefab and/or Gilbane Building Company, Trevino was injured when a lift operated by John Doe suddenly and violently lowered without warning. The incident resulted in severe and permanent injuries to Trevino. The plaintiff claims that both Baker Triangle Prefab and Gilbane Building Company had actual knowledge of the dangers present at the worksite but failed to warn him or take necessary precautions to ensure his safety.

The lawsuit alleges multiple counts of negligence against all defendants. Specifically, it accuses John Doe of failing to ensure the safety of those around him and not checking if the area was safe before lowering the lift. Additionally, Baker Triangle Prefab and Gilbane Building Company are accused of breaching their duty of care by failing to provide a safe workplace and maintain the premises in a reasonably safe condition. They are also charged with failing to give adequate warnings about unsafe conditions and not enforcing proper safety measures.

Trevino's complaint seeks monetary relief exceeding $250,000 but not more than $1 million for medical expenses (both past and future), physical pain and suffering, mental anguish, loss of earnings capacity, physical impairment or incapacity, physical disfigurement, loss of enjoyment of life, and exemplary damages. He also requests pre-judgment and post-judgment interest on all accrued damages.

Representing Adrian Trevino is attorney Alex P. Boylhart from Kwok Daniel Ltd., L.L.P., while the case will be heard in Harris County District Court under Case ID 2024-43662 by Judge Gerardo Perez.
