Shopper Sues Major Retail Chain Over Slip-and-Fall Accident

A shopper has filed a lawsuit against a major retail chain following an accident at one of its stores. Silvia Leticia Canales filed the complaint in the District Court of Harris County, Texas, on July 26, 2024, accusing Wal-Mart Stores Texas, L.L.C. of negligence leading to her injuries.

According to the court documents, Canales was shopping at the Wal-Mart store located at 5501 Highway 6 in Missouri City, Texas, on December 23, 2022. As she was entering the restroom near the cash registers, she slipped on a liquid that had leaked from a nearby water fountain. The plaintiff alleges that this hazardous condition was known or should have been known by Wal-Mart but was neither cleaned up nor marked with any warning signs. This negligence resulted in personal injuries for which Canales is seeking damages.

Canales claims that she did nothing to cause her own injuries and that all responsibility lies with Wal-Mart for failing to maintain safe premises. "Defendant knew or should have known an unreasonably dangerous condition existed which posed an unreasonable risk of harm," states the petition. The document further asserts that Wal-Mart failed in its duty to inspect and make safe or adequately warn customers about the hazardous condition.

The plaintiff is pursuing monetary relief exceeding $1 million for various damages including past and future medical expenses, physical pain and suffering, mental anguish, loss of earnings and earning capacity, loss of consortium and household services, disfigurement, property damage, and exemplary damages due to what she describes as Wal-Mart's "conscious indifference" to her safety.

Representing Silvia Leticia Canales is attorney Kristin Suniga from the Law Offices of Marcos & Associates P.C., based in Houston. The case has been assigned Case ID 2024-47254 and will be heard by Judge Talitha McCarty in the 295th Judicial District Court of Harris County.
