A Houston resident has filed a lawsuit against a local restaurant, alleging negligence that led to severe injuries. Pedro Abasolo lodged the complaint against Toca Madera Houston LLC in Harris County District Court on July 25, 2024.
According to the court documents, Abasolo claims that on June 16, 2024, he visited Toca Madera's premises located at 1755 Allen Parkway, Suite 101 in Houston. While walking along a concrete path towards the restaurant entrance, he stepped into a dark trench filled with water parallel to the walkway. The trench was not visibly distinct from the walkway and lacked any warning signs or barriers. As a result of this incident, Abasolo suffered extensive and permanent injuries.
The plaintiff asserts that Toca Madera Houston LLC was negligent in maintaining its premises. The complaint details several specific allegations: failure to post caution signs or verbally warn patrons about the trench filled with water, failure to place barriers around the hazardous area, and failure to inspect and maintain safe conditions on their property. "Defendant knew or reasonably should have known of the danger posed by the trench filled with water," states the petition.
Abasolo is seeking monetary relief exceeding $250,000 but not more than $1,000,000 for medical expenses (both past and future), pain and suffering, mental anguish, physical impairment, lost wages, and loss of earning capacity. Additionally, he requests exemplary damages due to what he describes as an extreme degree of risk taken by Toca Madera Houston LLC despite being aware of potential harm.
