Plaintiff alleges major tire service company’s negligence led to severe injuries

A Texas woman has filed a lawsuit against a major tire and battery service company, alleging severe personal injuries due to negligence. Elizabeth Semien lodged the complaint against NTW, LLC doing business as NTB - National Tire & Battery in Harris County District Court on August 16, 2024.

The incident in question occurred on October 14, 2023, when Semien visited an NTB location in Sugar Land, Texas to have a flat tire repaired. According to the filing, employees at the store requested that she retrieve her receipt from her car while it was already in the service bay. Unbeknownst to Semien, there was an unsecured wire on the ground which caused her to trip and suffer serious injuries. The complaint states that "Defendant's agents and employees were proximately close to the substance in question for an extended period of time" and should have known about the hazard.

Semien's petition outlines several allegations of negligence against NTW, LLC. These include allowing non-employees into hazardous areas without proper precautions, failing to maintain safe conditions by not addressing or warning about hazards like unsecured wires, and neglecting to properly train their staff. Additionally, Semien accuses the company of gross negligence for showing "conscious indifference" towards her safety despite being aware of the risks involved.

The plaintiff is seeking various forms of relief including compensation for past and future medical expenses, physical pain and suffering, mental anguish, loss of earnings capacity, disfigurement, and exemplary damages. She has also requested a jury trial for this case.

Representing Elizabeth Semien is Ryan Steinhart from Attorney Brian White & Associates P.C., while no attorneys for NTW LLC have been listed yet. The case has been assigned Case ID 2024-54097 and will be heard in Harris County District Court by Judge Marilyn Burgess.
