Eleazar Espinoza has filed a lawsuit against Worldwide Power Products, LLC and an employee identified only as Edward, alleging negligence that led to serious personal injuries. The complaint was filed on January 23, 2025, in the District Court of Harris County, Texas. Espinoza claims that the defendants' failure to maintain safety standards resulted in an accident that caused permanent damage to his right index finger.

The incident occurred on January 25, 2023, when Espinoza, a truck driver, visited Worldwide Power Products' facility in Houston to pick up equipment. During the loading process, Edward operated a forklift to lift a KW 400 unit. According to the petition, safety devices were defective and improperly attached, leading to the equipment's sudden descent and crushing Espinoza's finger. The plaintiff accuses the defendants of failing to inspect and maintain their equipment properly and not utilizing necessary safety measures.

Espinoza argues that Worldwide Power Products is liable under the legal doctrine of respondeat superior since Edward was acting within his employment scope during the incident. Additionally, he claims negligent hiring and training practices by the company contributed to his injuries. The plaintiff asserts that these failures directly resulted in his physical harm and ongoing pain.

The lawsuit seeks damages exceeding $1 million for medical expenses, lost income due to an inability to work, and future loss of earning capacity. Espinoza requests a jury trial and aims for compensation covering past and future damages related to his injuries.
