A Harris County resident has filed a lawsuit against a local business, alleging negligence that led to serious personal injuries. Willie Jackson submitted the complaint in the District Court of Harris County, Texas on August 14, 2024, naming Independence Heights Ventures, LLC as the defendant.
According to the court documents, Jackson was injured on January 2, 2024, at approximately 7:00 p.m. while visiting Pitstop Express #5 located at 401 Crosstimbers St., Houston, Texas. The plaintiff claims he slipped and fell in an aisle after exiting the bathroom. As a result of this incident, Jackson asserts he sustained severe personal injuries leading to permanent bodily impairment. The complaint states that Jackson was an invitee on the premises for mutual benefit when the accident occurred.
Jackson's legal team argues that Independence Heights Ventures failed in its duty of care as a premises owner or operator. The complaint accuses the defendant of not exercising ordinary care to ensure safety or warn invitees about potential dangers. "Defendant’s conduct—both its acts and omissions—constituted a breach of the duty of ordinary care owed by a premises owner or operator to its invitees," reads the filing. It further claims that these failures created an unreasonable risk of harm that was foreseeable and directly caused Jackson's injuries.
The plaintiff is seeking monetary relief less than $250,000 for medical expenses incurred and expected future costs due to his injuries. Additionally, Jackson requests prejudgment interest from the date of the incident until judgment is entered and post-judgment interest on any awarded amount until it is paid in full. He also seeks compensation for physical suffering and mental anguish endured due to the incident.
