Resident Sues Property Management Company Over Negligence Leading to Injury

A recent court filing has brought to light serious allegations of negligence against a property management company. Norma Martinez filed a complaint in the District Court of Harris County, Texas, on August 29, 2024, accusing JAW Equity Management, LLC of maintaining dangerous conditions at one of their properties.

According to the complaint, Norma Martinez is a resident of Harris County and was an invitee at Breckenridge Court Apartments, located at 16150 Kieth Harrow Blvd., Houston. On April 10, 2023, while walking down a flight of stairs at the apartment complex, she attempted to grab a handrail that was loose. This caused her to slip and fall, resulting in serious and permanent bodily injuries. Martinez claims that JAW Equity Management was negligent in maintaining the premises and failed to correct or warn about the dangerous condition.

The plaintiff's petition details multiple instances of alleged negligence by JAW Equity Management. It states that the company negligently created or allowed the hazardous condition to exist without taking corrective measures or adequately warning residents and visitors. Specific accusations include failing to provide a safe walking environment, not inspecting the area where the incident occurred, inadequate supervision and training of employees regarding property inspections and maintenance, and not following their own policies for identifying and addressing dangerous conditions.

Martinez argues that JAW Equity Management had actual or constructive knowledge of the unreasonably dangerous condition posed by the loose handrail but did nothing to mitigate it. She asserts that her injuries were directly caused by this negligence and not by any action or inaction on her part.

In terms of relief sought from the court, Martinez is requesting monetary compensation for various damages including past and future physical pain and disability, mental anguish, loss of earnings and earning capacity, medical expenses incurred due to her injuries, disfigurement, and physical impairment. She has specified that she seeks monetary relief over $250,000 but not more than $1 million.
