Plaintiff Alleges Negligence Against Prolific Transport Over Trailer Accident

A catastrophic incident involving a shipping container has led to a lawsuit against a transport company. Miguel Angel Torres filed the complaint in the District Court of Harris County, Texas, on September 13, 2024, naming Prolific 2 Transport LLC, Prolific Transport 5 LLC, and Leonard Daniels as defendants.

According to the court documents, Torres alleges that in November 2022, he contracted with Prolific Transport to deliver a shipping container on a trailer to an address in Houston. The trailer was delivered on November 22, 2022. However, when Torres began loading items into the container later that day, the landing gear shoe broke, causing the trailer and container to fall over while Torres was inside. This accident resulted in severe injuries to Torres' head, neck, back, and body.

Torres claims that Prolific Transport failed to maintain the trailer in a safe condition and misrepresented its safety. "Defendant Prolific Transport owed a legal duty to Plaintiff Torres to provide him with a trailer that is safe and fit for its ordinary use and purpose," states the complaint. The document further accuses Prolific Transport of negligent misrepresentation by assuring Torres that the trailer was safe when it was not.

The plaintiff is seeking damages exceeding $1 million for medical expenses (both past and future), physical pain and suffering (both past and future), physical impairment (both past and future), loss of earnings (both past and future), loss of earning capacity (both past and future), loss of enjoyment of life, and other related damages. Additionally, Torres is asking for exemplary damages due to what he describes as "an extreme degree of risk" knowingly undertaken by Prolific Transport.

Representing Miguel Angel Torres are attorneys Rick Barrera from Barrera Law Group LLC based in Odessa, Texas, and William Edward “Will” Mejia from The Mejia Law Firm located in Houston. The case has been assigned Case ID 2024-62411 in the 164th Judicial District Court under Judge Monica Jackson.
