The lawsuit arises from an incident that occurred on September 15, 2023, when Marcus Foster visited a Jack in the Box restaurant located at 7525 East Freeway in Houston, Texas. According to the petition, Foster slipped and fell due to a puddle of water approximately three feet from the entrance of the restaurant. As a result of this fall, Foster claims he sustained injuries that required medical attention and incurred related expenses.
Foster's petition outlines several accusations against Jack in the Box Inc., claiming that the company failed to maintain safe premises for its patrons. Specifically, it alleges that Jack in the Box had actual or constructive knowledge of hazardous conditions but did not take reasonable steps to eliminate or mitigate these risks. Furthermore, it accuses the company of failing to properly train and supervise employees responsible for maintaining safe conditions within their establishments.
