Plaintiff Alleges Retailer Negligence After Slip-and-Fall Incident

In a compelling legal development, a Texas resident has filed a lawsuit against a business establishment following an incident that allegedly caused her significant injury. On October 10, 2024, Karen Scott initiated legal proceedings in the District Court of Harris County, Texas, against Painted Tree Cinco Ranch, LLC. The case revolves around an alleged slip and fall incident that occurred on June 14, 2021, at the defendant's store located in Katy, Texas.

Karen Scott's complaint accuses Painted Tree Cinco Ranch of negligence and premises liability after she slipped on what she describes as an unreasonably dangerous condition on the store floor. Scott claims that this hazard was either created or negligently ignored by the store's management and employees. "Defendant had a duty to Plaintiff Mrs. Scott to provide her with a reasonably safe shopping premises," the petition states. It further alleges that the defendant failed to mark or clean up the hazardous area despite having sufficient time to do so.

The plaintiff asserts that her injuries were severe and resulted in significant physical pain, mental anguish, and loss of enjoyment of life. She contends that these damages are ongoing and will continue into the future. In addition to general damages for pain and suffering, Scott is seeking compensation for medical expenses incurred due to the incident and anticipates future medical costs.

Scott is demanding monetary relief ranging from $250,000 to $1 million as compensation for her injuries and associated damages. Her legal team argues that Painted Tree Cinco Ranch breached its duty of care by failing to maintain safe premises for its customers—a responsibility inherent in operating a retail establishment open to public invitees like Scott.

Represented by Jeffrey N. Todd from The Todd Law Group PLLC, Karen Scott is seeking not only compensatory damages but also pre-judgment and post-judgment interest at the highest rates allowed by law until any judgment is fully satisfied. The case has been assigned Case ID 2024-70334 in Harris County's 127th Judicial District Court.
